Who runs Fay

Fay is run under the name Fuchiba. Fuchiba is not a registered company. It is a trading name used by one individual who builds and operates this service, and "we" throughout these terms means that person. There is no staff, no legal department, and no corporate parent standing behind the service.

This is worth stating plainly, because it shapes everything below. Support is answered by one person. So is any complaint.

These terms

By creating a Fay account, your organization agrees to these terms. If you are accepting on behalf of an organization, whether a choir, community center, little theater, historical society or garden club, you are confirming that you have the authority to do that. Please read this alongside our Privacy Policy and Cookie Policy.

Account terms

You need a valid email address to create an account. You are responsible for keeping your password secure and for everything that happens under your account. Let us know right away at [email protected] if you think someone else has gained access to it. Depending on your plan, more than one person on your team may use the same account.

Acceptable use

Use Fay the way it is meant to be used, which is to manage relationships with your own audience. Don't store data you don't have the right to store, don't try to reach other organizations' accounts, don't resell or sublicense access to Fay, and don't use the service to send spam or harass anyone. We can suspend accounts that put other customers or the service itself at risk.

Your data

Everything you store in Fay about your audience belongs to you rather than to us: names, contact details, households, attendance, orders, donations and notes. We are simply the software that holds it and helps you use it. We never sell your data and never use it for advertising. You can export it as a CSV file at any time.

When your account closes, we handle your data the way our Privacy Policy describes: a 30-day grace period, then permanent deletion within 90 days.

Plans and billing

Fay offers three plans: Solo, which is free; Ensemble, at $29 a month, with a 60-day free trial and no card required to start; and Chorus, at $79 a month. Paying yearly gets you two months free compared to paying monthly.

Billing is handled by a third-party payment processor, so your card details never touch our servers. Fees are billed in advance for the period you choose.

Cancellation and termination

You can cancel anytime from your account settings. We don't offer refunds for partial months, but your exported data remains available to you as described in our Privacy Policy.

We may suspend or close an account that violates these terms, seriously misuses the service, or has significantly overdue payment. When we reasonably can, we will give you notice and a chance to fix things first.

Warranty disclaimer

Fay is provided "as is." We work hard to keep it reliable, but we don't promise it will be error-free or uninterrupted, and to the extent the law allows, we don't make other warranties beyond what is explicitly stated in these terms.

Limitation of liability

To the extent permitted by law, Fuchiba is not liable for indirect, incidental or consequential damages arising from your use of the service. Total liability for any claim related to Fay is limited to the amount you paid us in the twelve months before the claim arose.

Disputes

Fuchiba is one individual rather than a company, and these terms do not nominate a court, a country or an arbitration body to hear a dispute. If something goes wrong, write to [email protected] and it will be read by the person who can actually fix it. Most problems are a refund, an export or a deletion, and all three can be done the same week.

Nothing here takes away rights you have under the consumer or data protection law that applies where you live. Those rights apply whatever this document says, and if a court with authority over one of us decides a term above is unenforceable, the rest still stands.

Changes to these terms

We may update these terms as Fay changes. We will notify you by email or an in-app notice before a material change takes effect. Continuing to use Fay after that point means you accept the updated terms.
